We appreciate your business.At Thriftychichome.com, we make every effort to accurately represent the condition of our items for sale. All items are sale as is.This Agreement applies to all Lots and all Products included in those lots sold through the Marketplace.
1. Acceptance of Merchandise
The Buyer is recognized as a professional Buyer taking all responsibilities for the purchased products, including:
a) assuming a discrepancy risk of 5% between the manifest and the stock received
b) understanding that product descriptions and condition details are provided as guidance only and shall not constitute any warranty as to the product condition or quality
c) acknowledging that all merchandise is sold “AS IS” and “WITH ALL FAULTS”, with no warranties expressed or implied, and it is the Buyer's responsibility to assess the quality and condition of each product purchased
d) understanding that all sales are final, and Buyer may not return any of the listed Products to Thriftychichome for a refund or exchange, except the group buy & wholesale products.
e) understanding that any request regarding short shipment, damaged goods, or any other inquiry related to the conditions, quality, or quantity of a specific order must be sent to info@thriftychichome.com within 3 business days of receiving the goods
f) assuming that the export of some or all products purchased may be prohibited or restricted by the export control laws of Canada
g) acknowledging that in the event of an order cancellation, a 15% restocking fee will be applied. Refused shipments will also be treated as order cancellations and subject to the same 15% restocking fee.
4. Limitations of Warranties
All Products sold do not carry any manufacturer or retailer warranty and cannot be returned to the store or manufacturer for replacement, credit, refund, or any other compensation. The sole warranty that applies is the 30-days offered by Thriftychichome on all Wholesale Products sold through the Marketplace.
5. Limitations of Liability
The Buyer accepts full responsibility for the risk arising from any Products purchased from Thriftychichome. In no event shall Thriftychichome or its affiliates, associates, employees, partners, administrators, or suppliers be liable for any incident or damages related to Products purchased by the Buyer. The Buyer understands that the Products purchased may not be in their original condition or specification, and the user may have a different experience from the product's original purpose. This provision will survive the termination of this Agreement.
6. Orders Pick-up
Buyer is responsible for arranging the pick-up of all pick-up orders within 5 business days of purchase. If the Buyer is unable to comply, they must advise Thriftychichome by sending an email to info@thriftychichome.com.com and advise when they will be able to proceed to pick-up. Thriftychichome reserves the right to ship the merchandise at the customer's cost or to cancel the order and charge a cancellation fee of 15% of the total order.
7. Compliance with Laws
Thriftychichome can, at its sole discretion, terminate this agreement if the Buyer does not comply with all applicable laws and regulations, including but not limited to:
a) disposal of electronics waste
b) exportation regulations
c) transportation of hazardous material
d) payment and remittance of Provincial and Federal sales taxes.
8. Sever-ability
If any provision of this Agreement is declared unenforceable or invalid by a court of competent jurisdiction, the same will not impair any of the other provisions contained in this Agreement
